Terms of Service

Apex Trace is a personal health dashboard for iOS and Android. The short version: use the app for general wellness only — it's not a medical device, it's provided "as is", and your data stays on your phone. These terms are the agreement between you and us for using the app.

01 Acceptance of these terms

These Terms of Service ("Terms") form a binding agreement between you and the developer of Apex Trace ("Apex Trace", "we", "us") governing your use of the Apex Trace mobile app and this website (together, the "Service"). By downloading, installing, or using the Service you agree to these Terms. If you don't agree, don't use the Service.

Your use of the Service is also subject to the rules of the app store you downloaded it from (Apple App Store or Google Play). Where those store terms conflict with these Terms, the store terms govern your relationship with the store.

02 What Apex Trace is

Apex Trace is a client-only app that, with your explicit consent, reads your Google Health data on a read-only basis and renders dashboards, charts, trends, scores, and coaching insights on your device. It has no backend that we operate; we do not receive or store your health data. How we handle data is described in our Privacy Policy, which is incorporated into these Terms.

03 Eligibility

You must be at least 16 years old and able to form a binding contract to use the Service. The Service is not directed at children under 16 and must not be used with a child's Google account.

Optional Supporter subscription. Separately from the one-time unlock, you can support the app's development with an auto-renewable monthly subscription at one of a few fixed price tiers of your choosing. It is entirely optional — every health feature is included in the one-time unlock — and while active it grants only cosmetic extras: a Supporter badge in your profile and additional chart color palettes.

07 Not a medical device

Apex Trace displays estimates for general wellness and informational purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Scores, insights, and coaching text (including text generated by your phone's on-device AI) may be inaccurate or incomplete and must not be relied on for any medical decision. Always consult a qualified healthcare professional with questions about your health, and seek emergency care for emergencies. Never disregard professional medical advice because of something shown in the app.

08 Intellectual property

The Service, including its software, design, text, and branding, is owned by us or our licensors and protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for your own personal, non-commercial use, subject to these Terms. We reserve all rights not expressly granted. Fitbit and Google Health are trademarks of Google LLC; Apex Trace is an independent app and is not affiliated with, endorsed by, or sponsored by Google LLC.

09 Third-party services

The Service relies on third-party services, including Google sign-in and the Google Health API, the app stores, and (only if you opt in) the Sentry crash-reporting service. Your use of those services is governed by their own terms and policies. We are not responsible for third-party services and their availability is outside our control.

10 Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any estimate, score, or insight is accurate. Some jurisdictions don't allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

11 Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the app in the 12 months before the claim or USD 25. Nothing in these Terms limits liability that cannot be limited by law.

12 Indemnification

You agree to indemnify and hold us harmless from any claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or of any applicable law or third-party right.

13 Termination

You may stop using the Service at any time by disconnecting and uninstalling the app. We may suspend or terminate access if you materially breach these Terms or where required by law or by a third-party provider. Sections that by their nature should survive termination (including sections 7, 8, 10, 11, 12, and 15) will survive.

14 Changes to the Service or these Terms

We may modify the Service or these Terms from time to time. We'll post the updated Terms here and update the effective date, and note material changes in release notes. Your continued use of the Service after changes take effect means you accept the updated Terms.

15 Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection rights you have where you live. You and we agree that the state and federal courts located in Florida will have exclusive jurisdiction over any dispute arising out of these Terms, except where applicable law gives you the right to bring a claim in your local courts. The app stores' own terms govern disputes about purchases made through them.
